How to Navigate a DUI Checkpoint

The main goal of DUI checkpoints, according to the Kansas Department of Transportation (DOT) is to ensure that a driver who is drinking believes that they have a much higher chance of being caught. The checkpoint system essentially tries to intimidate people out of drinking and driving to begin with. Unfortunately, once you are going through a DUI checkpoint, you may find yourself arrested and charged, even if there was a misunderstanding or if your situation was blown way out of proportion.

Tips for Going through a Checkpoint in Kansas City, KS

There are very strict laws that govern your rights as an American citizen. For example, laws exist to protect you from unreasonable search and seizure. If any evidence was obtained against you as the result of illegal search and seizure, it might not be held against you in court.

Found yourself going through a checkpoint? Keep these things in mind:

  • Remain Respectful but Silent: Be polite and as respectful as possible when interacting with the police officers, so that they can’t hold your behavior against you. Do not answer any questions that would incriminate you or cast you in a bad light.
  • Provide Basic Information: Officers can only ask you to provide your driver’s license and proof of insurance. You are obligated to give them this information, but nothing more. Politely request that you speak with your lawyer before answering other questions.
  • Do Not Consent: You have the right to withhold your consent to any searches. Police officers are trained to look for “probable cause” that would allow them to search your vehicle. If you verbally refuse consent, your attorney may be able to argue that the search was unlawful.
  • Refuse Field Tests: You are not obligated to perform a field sobriety test – where you get out of your car to perform a series of coordination and motor skills tests. You are allowed to politely ask why you need to do this test and refuse, stating that you want to speak with your lawyer.
